This is such an important topic Bebe. I'm glad you are writing about it. My ex-husband remarried after hiding every dime we had. I want that money to go to my children because half of it's mine. The woman he married is twice divorced and both husband's are dead. She married him for the money. He created an illegal trust during divorce to hide money. He also created a new will once he got engaged to her leaving everything to our children but he did it online and I doubt he notarized nor did he give a copy to any of our children so if she found it and threw it out there would be no law firm to call to get a legitimate copy. It's not just dementia. A spouse could get sick and become incoherent during a long term illness and be manipulated to sign new paperwork then. Manipulative people will find a way. There is something else that I haven't looked into entirely. I believe there is a difference in a Trust with no appointee and a Trust with one. Meaning if my ex-husband had a legitimate trust with say his sister appointed to make sure it was distributed to our children then his new wife couldn't touch it but if he has a trust just leaving the money to our children she could. But I haven't researched that yet. I don't care if she gets half of his money but the half he stole from me during a divorce is mine and I want our children to get that.
